GENERAL TERMS AND CONDITIONS OF USE AND SALE

These General Terms and Conditions of Use and Sale (hereinafter referred to as the "General Terms") govern, together with the Privacy Policy and the Cookies Policy, the access to and use of the website www.casapablo.es/tienda, as well as the purchase of products and/or services through it. Mere access to the Portal grants the person accessing it the status of User (hereinafter referred to as the “User”) and implies the acceptance of all the terms included in these General Terms. If the User does not agree with these Terms, they must immediately leave the Portal without using it.

By accepting these General Terms, the User declares that:

They have read, understand, and comprehend the contents herein.

They are of legal age under the applicable laws in their country of residence, or have parental or legal guardian consent if underage.

If purchasing any product and/or service, they have the legal capacity to do so.

They assume all obligations set forth herein.

The User must carefully read these Terms each time they access the Portal, as the Portal and the Terms may undergo modifications.

The owner of the Portal reserves the right to make, at any time, any changes or updates to its content and services, these General Terms, and, in general, any elements of the Portal's design and configuration.

Modifications to these Terms shall not affect products or promotions purchased prior to such modifications.

If Casa Pablo Vinos y Licores entrusts a third party with the custody of different versions of the General Terms, both parties recognize the version recorded in said trusted third party’s database as the only valid one at all times.

2. TERMS OF USE

2.1. Access to the Portal

Access to the Portal is free of charge, except for the cost of the Internet connection provided by the User’s access provider.

2.2. Registration Requirement

Use of certain services and content may be subject to prior registration. User data must be accurate and up to date. The registered User is responsible for the confidentiality of their password and liable for any damage resulting from misuse.

2.3. Use Regulations

The User agrees to use the Portal in accordance with the law, moral standards, public order, and these Terms. The User shall not:

Post content that is racist, xenophobic, pornographic, terrorist, or contrary to human rights.

Spread viruses or malware.

Share data or content violating fundamental rights.

Send unauthorized advertising or spam.

Impersonate another user.

Violate intellectual or industrial property rights.

Violate communication confidentiality or data protection laws.

CASA PABLO VINOS reserves the right to seek compensation for damages and to take legal action.

2.4. Disclaimer of Liability

CASA PABLO VINOS is not responsible for:

Presence of harmful elements (e.g., viruses).

Damage to user hardware/software from using the Portal.

Service interruptions due to network failures.

2.5. Linked Content and Services

CASA PABLO VINOS is not responsible for third-party content accessed through links, except when it has actual knowledge of illegal content and fails to act.

2.6. Intellectual and Industrial Property

All content on the Portal is protected by intellectual property laws and belongs to CASA PABLO VINOS or third parties. No rights are granted to the User other than what is strictly necessary for the use of the Portal.

By posting comments, the User grants CASA PABLO VINOS a non-exclusive, worldwide license to reproduce, distribute, and publicly communicate such content for promotional and service purposes.

3. TERMS OF SALE

3.1. User Registration

Registering on the Portal requires providing full name and email. Confirmation is sent via email. Users can manage their personal data, orders, invoices, gift cards, and cancel their account under “My Account.”

3.2. Shipping Conditions

We only ship to mainland Spain and the Balearic Islands. Shipping costs vary by location:

Free shipping:

• Over €60 in Marbella
• Over €70 in Ojén, Mijas Costa, Estepona, and Benahavís
• Over €100 in mainland Spain (except Balearic Islands)
• Over €200 in Balearic Islands

Standard shipping costs:

Marbella / San Pedro: €5

Estepona / Benahavís / Mijas / Ojén: €5

Mallorca: €25

Mainland Spain: €9.90

Shipping includes packaging, insurance, and VAT. Orders may be returned to origin if delivery is unsuccessful after 4 days.

3.3. Returns

Returns must be requested within 15 natural days. Policies vary:

Wines: Exchange only. No monetary refund.

Spirits < €100: Exchange only if unopened and in original condition.

Spirits > €100: Exchange/refund only for factory defects or damage.

Experiences (Art&Wine / Tastings): No refund. Value can be redeemed for store credit if cancellation is made at least 72h in advance.

Request returns via email: online@casapablo.es/tienda with photos and order number.

3.4. Gift Cards

Gift cards are non-refundable, non-transferable for cash, and do not expire. The holder of the code can redeem it. Treat codes confidentially.

3.5. Product Selection

Users can add products to the cart and modify the contents before finalizing the order.

3.6. Order Processing

After confirming the cart, the User must provide shipping and billing information and select a payment method. Upon successful payment, an order confirmation will be sent.

3.7. Product Prices

Prices are listed in Euros and include VAT.

3.8. Payment Methods

• Bizum
• Cash (only Marbella)
• Casa Pablo gift cards

3.8.1. International Bank Transfers

A fixed fee of €18 will be charged. The order will be processed once the full amount is received in our account.

3.9. Order Confirmation

An order confirmation email will be sent with details of the purchase and a link to the current Terms and Conditions.

3.10. Right of Withdrawal

Users have 14 calendar days to withdraw, except for perishable goods (e.g., opened wine bottles). Notification must be sent via email with order details. Refunds will be issued within 14 days, except for shipping costs.

4. Nullity and Ineffectiveness of Clauses

If any provision is deemed invalid, the rest shall remain in effect.

5. Applicable Law and Jurisdiction

In accordance with EU Regulation No. 524/2013, users may seek out-of-court consumer dispute resolution at: https://ec.europa.eu/consumers/odr/

These Terms are governed by Spanish law. Any disputes shall be submitted to the courts of the User’s residence.
